Welcome to the SensMax website. These Terms and Conditions (Terms) govern your access to and use of our website and outline the general terms of business for the purchase of our products and services.
1. General Information
The provider of hardware and software solutions under the SensMax brand is SensMax SIA (hereinafter SensMax), a company incorporated in the Republic of Latvia, registration number: 40103561281, with its registered office at Ganibu dambis 24B, Riga, LV-1005, Latvia.
This website is intended for informational purposes and does not function as an e-commerce platform. Direct online transactions are not supported.
2. Ordering and Payment Terms
- Commercial Process: All sales are conducted through direct communication. A binding contract is established only upon the issuance of an official Proforma Invoice or Invoice by SensMax.
- Pricing: SensMax reserves the right to adjust pricing at its sole discretion without prior notice. Clients are required to confirm valid pricing before placing an order.
- Advance Payment: All orders are subject to 100% advance payment. No orders will be processed, manufactured, or dispatched until the full invoiced amount has been credited to the SensMax bank account.
3. Delivery and Shipping
- Incoterms: Standard delivery terms are DAP (Incoterms 2020) at the Buyer's designated location, unless otherwise specified in writing.
- Customs and Import Duties: The Buyer is exclusively responsible for all import procedures, including the payment of customs duties, VAT, and any other local taxes or administrative fees in the country of destination.
- Lead Times: Standard dispatch occurs within 3–5 business days of payment receipt, provided the items are in stock.
- Transfer of Risk: Liability for the goods passes to the Buyer once the shipment is handed over to the carrier. SensMax is not liable for any loss or damage occurring during transit.
4. Warranty and RMA Policy
- Warranty: A limited hardware warranty of 24 months (2 years) is provided, effective from the invoice date.
- No Returns: As a B2B provider, SensMax does not accept returns or exchanges for non-defective equipment that has been correctly supplied.
- RMA Procedure: For warranty claims, equipment must be shipped to the SensMax head office in Riga, Latvia, for inspection.
- Logistics Costs: The Buyer is responsible for all costs associated with warranty shipments, including freight, insurance, and duties for both inbound and outbound logistics.
5. Intellectual Property and Software
All intellectual property rights, including trademarks, firmware, and technical documentation, remain the sole property of SensMax SIA. Usage of this website or purchase of hardware does not constitute a transfer of any IP rights.
API and MQTT connectivity services are provided on an "as is" basis. SensMax does not guarantee integration compatibility with third-party software environments.
6. Limitation of Liability
The liability of SensMax is strictly limited to the repair or replacement of hardware under the warranty terms. SensMax shall not be held liable for any consequential, indirect, or incidental damages, such as loss of profits, data loss, or installation expenses.
7. Privacy and Cookies
This website uses cookies to enhance functionality and user experience. By continuing to browse, you consent to our use of cookies. Personal information provided via contact forms is handled in compliance with applicable data protection standards for the purpose of business communication and order fulfillment.
8. Governing Law
These Terms shall be governed by and interpreted according to the laws of the Republic of Latvia. Any disputes arising shall be subject to the exclusive jurisdiction of the Latvian courts.
